1. Service Description
Outlix ("we", "us", "our") provides an AI-powered sales outreach platform ("Service") that helps businesses generate personalized email drafts, manage lead outreach, and track email engagement. The Service uses artificial intelligence to assist with sales communication workflows.
By accessing or using Outlix, you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Account Terms
- You must be at least 18 years old to use this Service.
- One account per person. Sharing accounts is prohibited.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, complete, and current information when creating an account.
- Notify us immediately at support@outlix.io of any unauthorized access or security breach.
3. Acceptable Use Policy
You agree to use Outlix in compliance with all applicable laws and regulations, including but not limited to:
- CAN-SPAM Act (United States): All emails must include accurate sender information, clear subject lines, a physical address, and an unsubscribe mechanism.
- GDPR (European Union): You must obtain proper consent before sending emails to EU recipients and honor opt-out requests immediately.
- Other anti-spam laws: Comply with applicable email marketing laws in your jurisdiction and your recipients' jurisdictions.
You are expressly prohibited from:
- Sending spam or unsolicited bulk emails
- Sending emails to recipients who have not provided consent
- Using purchased, rented, or scraped email lists
- Misrepresenting your identity or affiliation in emails
- Sending emails with deceptive subject lines or content
- Using the Service for illegal, fraudulent, or malicious purposes
- Transmitting malware, viruses, or harmful code
- Attempting to gain unauthorized access to our systems or other users' accounts
- Scraping, copying, or reverse engineering any part of the Service
- Using the Service to compete with us or build a similar product
- Violating any third-party rights, including intellectual property or privacy rights
Your Responsibility: You are solely responsible for the content of emails sent through the Service and for ensuring you have proper consent to contact each recipient. We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.
4. Subscription & Billing
4.1 Pricing Plans
Outlix offers the following subscription plans:
Annual subscriptions are available at a discounted rate. Pricing is subject to change with 30 days notice to existing subscribers.
4.2 Payment Processing
Paddle is our Merchant of Record. All payments, billing, taxes, and invoices are handled by Paddle. By subscribing, you agree to Paddle's terms and conditions. Paddle will appear on your credit card statement.
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. Payments are processed automatically through Paddle.
4.3 Refunds
We offer a 30-day money-back guarantee on your first subscription payment. Refunds are managed by Paddle according to our Refund Policy.
5. Usage Limits
Each subscription plan includes specific usage limits for features such as:
- Number of AI-generated drafts per month
- Number of emails sent per month
- Number of leads/contacts
- API request limits
- Storage limits
If you exceed your plan's usage limits, we may:
- Offer you the option to purchase additional usage credits
- Automatically upgrade you to a higher plan (with your consent)
- Temporarily restrict access to certain features until your next billing cycle
Usage limits are enforced per organization and reset at the beginning of each billing period.
6. Intellectual Property
6.1 Your Data
You retain all ownership rights to your data. This includes:
- Lead information (names, emails, companies)
- Email draft content
- Product descriptions and positioning
- Any other content you upload or create using the Service
By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service (e.g., generating AI drafts, sending emails, tracking engagement). We will never sell your data to third parties.
6.2 Outlix Platform
The Service, including all software, design, text, graphics, logos, and trademarks, is owned by Outlix and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our express written permission.
7. AI-Generated Content
Outlix uses artificial intelligence (AI) models to generate email draft suggestions. AI-generated content is provided as suggestions only.
You are solely responsible for:
- Reviewing all AI-generated content before sending
- Ensuring content is accurate, appropriate, and compliant with applicable laws
- Approving or editing drafts as needed
- The content of any emails sent through the Service
We do not guarantee:
- Factual accuracy of AI-generated content
- Appropriateness of AI-generated tone or messaging
- Compliance with industry-specific regulations
- That AI-generated content will achieve desired results
We strongly recommend implementing a human review process for all AI-generated content before sending to recipients.
8. Data Handling
Our collection, use, and protection of your data is described in detail in our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the data practices described in our Privacy Policy, including the processing of your data by third-party AI providers (Groq, Anthropic, OpenAI) for the purpose of generating email drafts.
9. Service Availability
We strive to provide reliable service, but we do not guarantee uninterrupted or error-free access to the Service. The Service may be unavailable due to:
- Scheduled maintenance (announced in advance when possible)
- Emergency maintenance or security updates
- Third-party service failures (AI providers, email delivery, infrastructure)
- Force majeure events beyond our control
No SLA Guarantee for Non-Enterprise Plans: Standard subscription plans do not include a Service Level Agreement (SLA) or uptime guarantee. Enterprise customers may negotiate custom SLA terms.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTLIX SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from use of third-party AI providers or email delivery services
- Damages resulting from AI-generated content inaccuracies
- Damages resulting from service interruptions or downtime
- Damages arising from unauthorized access to your account
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
11. Account Termination
11.1 Your Right to Cancel
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
Upon cancellation, you will have 30 days to export your data before it is deleted.
11.2 Our Right to Terminate
We reserve the right to suspend or terminate your account immediately if:
- You violate these Terms of Service or our Acceptable Use Policy
- You engage in fraudulent or illegal activity
- Your payment method fails or your account is overdue
- We receive complaints about spam or abusive emails from your account
- We are required to do so by law or legal process
- We discontinue the Service (with at least 30 days notice)
In the event of termination for violations, you will not be entitled to a refund.
12. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
13. Governing Law
These Terms are governed by the laws of the Netherlands. The courts of Amsterdam, Netherlands shall have exclusive jurisdiction over any disputes arising from these Terms or the Service.
You agree to resolve any disputes through good faith negotiations first before pursuing legal action.
